你分局《关于对非法网络炒汇行为有关问题认定的请示（深外管［２００８］１２１号）收悉。现批复如下：

根据《银行业监督管理法》《商业银行法》《外汇管理条例》（国务院令１９９６年１９３号）《非法金融机构和非法金融业务活动取缔办法（国务院令１９９８年第２４７号）《个人外汇管理办法（中国人民银行令２００６年第３号）《关于严厉查处非法外汇期货和外汇按金交易活动的通知（证监发字［１９９４］１６５号）等相关法律、法规及部门规章的规定，境内个人从事外汇按金等外汇买卖交易，应当通过依法取得相应业务资格的境内金融机构办理。未依法取得行业监管部门的批准或者备案同意，任何单位和个人一律不得擅自经营外汇按金交易。擅自从事外汇按金交易的双方权益不受法律保护，组织和参与这种交易，属于非法经营外汇业务和私自买卖外汇行为。
